What are the Tax Implications of a Home Loan Modification

What is a Mortgage Loan Modification?
The first mortgage loan modification law was created after the Great Depression to help keep struggling families in their homes. When the recent U.S. housing marketing bubble began to burst, the concept started gaining attention again.

The concept of a loan modification is actually quite simple: negotiating a modification to your mortgage loan so that you will not be forced into a short sale or foreclosure. It’s a win for banks because they avoid having to resell a foreclosed property, and it’s a win for consumers because they get to stay in their homes.

Although modifications to a loan will vary depending on a homeowner’s current financial situation, the list below includes the most common types of modifications that can be made:

• Reduction in interest, or a change from a floating to a fixed rate
• Reduction in principal amount
• Reduction in late fees and penalties
• Lengthening of the loan term

The Mortgage Debt Relief Act
Before 2007, all forgiven mortgage debt was considered taxable income. Therefore, if, as part of your loan modification, your lender agreed to reduce your principal amount (e.g. by $20,000), then you would have been required to claim that as income on your tax return. However, as loan modifications and foreclosures began to increase significantly, Congress passed the Mortgage Debt Relief Act (MDRA) in 2007, which excludes forgiven mortgage debt on a taxpayer’s principal residence as taxable income.

Principal Residence
Forgiven debt can only be excluded from your taxable income if the home is your principal residence. As such, if you obtain a loan modification for a rental property or summer home, the forgiven debt will be considered taxable income for IRS purposes unless the taxpayer qualifies for the “insolvency” exclusion or if it is discharged through bankruptcy.

Home Affordable Modification Program
Another big change in the loan modification industry to be aware of is the new federally enforced Home Affordable Modification Program (HAMP). The program, which took affect in 2009, offers incentives to mortgage companies to help homeowners stay in their homes. Because of this new program, the demand for loan modifications has increased tenfold, which has unfortunately slowed down the loan modification process for many struggling homeowners. If you are hoping to modify the terms of your loan, be patient as it may take a few months to complete the process.

Form 1099
If you are approved for a loan modification, which involves forgiven debt, then you may still receive an IRS Form 1099 at the end of the year. The total amount of the debt that was forgiven will be listed in box 2. However, do not be concerned just because you receive this form as it does not mean you will necessarily have to include the amount in your total income.

Form 982
If you receive a Form 1099, then you may need to file a Form 982 to seek exemption from your loan relief debts. To fill out Form 982, you will need to list the amount of debt that was forgiven, which you can find on your Form 1099. You will need to file your Form 982 with your tax return.

Please seek the assistance of a qualified tax professional if you are confused about the process or how to complete Form 982.

5 Great Reasons to Choose an Adjustable Rate Mortgage

When you're shopping for a new home or looking to refinance your existing home loan, it's very important to do your homework. Don't be afraid to know your options or to ask your lender questions. How long do you plan on staying in your home? Are you considering an Adjustable Rate Mortgage (ARM)?
Although ARMs have often been misunderstood in the past, you might be surprised to learn many people still choose ARMs. In fact, it can be a great financial opportunity for the right person. We've compiled a list of the top 5 reasons you may want to consider getting an ARM for your new home refinance or loan.
Why would you choose an ARM?
1. Lowest Possible Mortgage Rates. Interest rates are currently among the lowest in history and ARM loans are one way to bring them even lower. An ARM has a fixed period where the rate won't change, typically 3, 5 or 7 years. The rate is lower, often much lower, than the popular 30-year fixed rate mortgage. The market rate for an ARM today is at 3.875% vs. 5.125% for a conventional 30-year FHA mortgage.
2. You Don't Plan On Staying In A Mortgage Very Long. Because homeowners know they are only in a fixed-rate period for a short amount of time, an Adjustable Rate Mortgage is best used if you know you are moving before the fixed-rate period is over, if you plan on using the money saved by the lower interest rate to pay more towards your premium or if you're planning on refinancing before the ARM begins to adjust.
3. You Can Save Money. Even including closing costs on a refinance, you are still saving money over a traditional mortgage. For example on a $200,000 home loan, if you were to get a 30-year fixed-rate mortgage at 4.75%, your monthly payments would be $1,043 a month. If you were to get a 5-year ARM at 3.5%, your monthly payments would be $898 for a 5-year savings of $8,700. Add in closing costs - at $2,000, even - you will still save $5,700 of your hard earned money.
4. ARMs do not always adjust up! Most people assume that after the fixed period expires, their rate will rise. This is not always the case. You could start with a 5-year ARM at 4.25% and when it becomes time for the rate to adjust, market prices may be considerably lower. This can prove to be quite a bit of savings for you to pay towards the principle of your home, or use the money to pay off debt!
5. Adjustable Rate Mortgages are more popular than you think. In the United States, may financially savvy people choose an ARM, mainly because you can save money. In fact, in some countries, like Canada or the United Kingdom, ARMs are the most common form of home loans. This is often due to the fact that you can pay more towards the principle of the loan, early and without penalty. Early reduction payments reduce the total cost of the loan and allow you to pay off your loan in less time.
Remember, while Adjustable Rate Mortgages are able to save you money over the fixed-rate period, they may not be for everyone. Make sure you talk to your mortgage lender to determine if an ARM is for you, make sure you know all of the facts before signing. Does your lender have prepayment penalties? What is the fixed-rate ratio? Make sure you are aware that while rates can go down - this means they also can rise as well. If you are aware of the risks, and have a firm understanding of how an ARM works, then it can prove to be a very positive experience for you!

Consolidation Loans Will Put Your Finances Back On Track.

This is the time of year that many people look forward to during the cold seasons of the year, as now the weather is good, the trees and flowers are in bloom, and the light evenings enable people to enjoy outside living
The holiday season is fast approaching and many are looking forward to their holidays from work, when they have a month to spend with their families that they are often rather busy in the course of the year to spend as much time with as they would like.
It has been a tough time for many over the past few years due to the credit crunch, with many having their working hours cut or working less overtime than normal or in fact working no over time at all.
Some families suffered financial loss due to a member of the household being made unemployed , and after such hard times this summer should be a special one with no financial worries and a good holiday to look forward to.
A lot of people did find themselves struggling during the recession and were, for example, forced to use their credit cards to survive, and to buy the essentials of life such as food and clothes for their children.
Some even had to use credit cards to pay their utility bills such as gas, electricity and phone bills, and at worse even their mortgage payment sometimes.
Therefore to look forward to a worry free summer this year would make this the right time to consider sorting out your finances, as juggling with too many debts is a strain on anyone.
The way to best rearrange financial outgoings is by debt consolidation that lumps all debts in the hard pressed, high balance, high interet rate credit cards and loans into the one much cheaper repayment every month.
Debt consolidation should be arranged by consolidation loans or debt consolidation loans, as they are sometimes called, and these loans will neatly pay off all debts and leave one low repayment in their place, and in addition to tidying up your borowings, will normally half your outgoings monthly and give you the peace of mind and contentment to plan your leisure time.
These consolidation loans are not readily available to tenants who only rent their home, unless they have an unusually kind bank manager, and this applies to private rented property as well as to local authority homes.
Those who own their own home can carry out debt consolidation by remortgages and secured loans and the savings will be great.
At present, remortgages are available from less that 2% for a tracker remortgage and at under 3% for a fixed remortgage, at loan to values of between 60% to 70%, making consolidation very cheap.
To really enjoy your spare time, now is the time to think about consolidation, and secured loans at from 9% are a good way to arrange this.

Barclays & Bovis Homes team up to offer mortgage deal

Barclays mortgage arm Woolwich, has launched a market-leading mortgage product offering borrowers up to 90% loan to value (LTV) available to those wanting to purchase a new home with Bovis Homes - one of Britain's leading housebuilders. The move by Woowlich mortgages is part of a new camapign to help stimulate the new-build market in a sustainable fashion while providing affordable mortgages for people that cannot afford large deposits.

The Insurance broking group Jardine Lloyd Thompson (JLT), who designed the innovative scheme in partnership with Barclays and Bovis Homes, is also offering free unemployment protection to buyers for a three year period starting on the date of exchange.

This new mortgage deal is offering one of the most competitive rates in its level since the start of the recession, fixed at 4.99% for two years on loans up to 90% LTV. After this fixed term the rate reverts to a lifetime tracker at base + 2.49%, which would equate to just 2.99% based on today's rate. The arrangement fee is £999.

The mortgage package has been nick-named 'The Perfect 10' and has been targeted at home-movers with limited equity, with the potential to particularly benefit first-time buyers who are currently able to avoid pay stamp duty on purchases up to £250,000. For example, a first-time buyer purchasing a Bovis Home for £150,000 would require a mortgage of £135,000, paying back £788.41 per month on a 25-year repayment basis.

Andy Gray, head of mortgages for Barclays said: "The deal struck today is about helping to get the housing market back on the right track but in a way that is sustainable in the long term. We believe this mortgage provides an affordable rate at 90%, striking the right balance for Barclays, Bovis Homes and its customers.

"We are now starting to see more competition and consumer confidence return to the market and we believe this gives the right level of rates with the security of a fixed rate deal for the first two years, ensuring that those with limited equity have the security of knowing what their payments are in the early years. This is about giving good rates at the right time which is excellent news for home-buyers and the housing market."

David Ritchie, Chief Executive of Bovis Homes, said: "In the current market, the ability of purchasers, especially first-time buyers, to access high loan to value mortgage finance has been severely curtailed. Working with Barclays, we have agreed 'The Perfect 10' mortgage package, which allows our customers to borrow up to 90 per cent of the value of their new Bovis Home at a very attractive fixed interest rate.

"Many of our potential customers are struggling to save the higher deposits required by the mortgage market today and this innovative new product, which is currently only available to us, will mean that more customers will be able to buy a new Bovis Home now, at a more affordable cost."

4 Tips to Choose the Best Home Mortgage

Since no particular mortgage is considered ideal for all homeowners, it is appropriate to follow these simple tips to come up with the one that can address your individual needs. Consider: reviewing your financial resources, inquiring about and comparing differences, determining the duration of payment, and negotiating and compromising rates.
A mortgage is a loan acquired by the buyer to secure real estate properties. The lender makes use of a promissory note as a proof of borrowing and gets hold of the land title until the buyer is able to pay off the amount borrowed. Some of the particulars found in the mortgage note are as follows: loaned amount, interest rate, and the duration of payment. However, since not all lenders offer the same rates or terms and conditions, it is advisable to thoroughly review some important points before committing to a particular lender.
Here are some things you should do before securing a loan in order to come up with the best rate:
Review financial resources
Before anything else, review your own financial resources to determine if you are capable of paying the mortgagee the borrowed amount. Anticipate possible consequences in case you decide to shell out a huge quantity in the future. Check whether or not this will affect your standard of living.
Inquire and compare
With the numerous loan providers offering such great financing, you need to carefully review which best suits your needs, how much interest rate they charge, and the payment terms. The types of loan, which include fixed, adjustable, and jumbo greatly vary in terms of monthly payment and each will affect the sum of funds you are will have. Contact various creditors ahead of time and inquire as much information as you can to fully understand what it is that you are about to undertake. Since deliberate delinquency may result in penalization, be prudent when choosing a loan provider.
Determine the duration of payment
Most people, especially those who belong to the average class, choose longer payment schemes. This will give them enough time to expend money at a lower amount. However, one must consider that the longer you want to settle your debt, the higher the amount you will be spending in entirety. Although this is ideal for workers who are low earners, this ultimately will turn out expensive if you try to sum up the whole outlay. Therefore, consider things conscientiously and assure advantages outweigh its disadvantages.
Negotiate and compromise
Sometimes, moneylenders provide flexible terms and conditions depending on some factors. Be ready with your convincing power. With circumstances beyond our control, one can't avoid rescheduling of payments due to some delays. Choose a company that has a kind heart for its clients and is willing to accommodate needs as a result of unforeseen circumstances.
As much as possible, make all things sensible when dealing with mortgages. Think things over for a while before advancing on the next step so you can avoid unfavorable consequences.

Fixed Rate Housing Loans

Fixed rate housing loans are the most traditional type of housing loan that a bank can offer. Its feature is just like its name, meaning that the rate that you are being offered is fixed.
Fixed for how long? Generally, as a rule of thumb, the longer you fix your loan, the higher interest rate you will be charged. When interest rates are low, it makes much sense to lock into that rate for a couple of years. Having a fixed rate home loan has its benefits. You do not have to worry about fluctuating interest rates. You do not have to bother about writing in to CPF to adjust your monthly payment just because the interest rate shot up.
Fixed rate is especially suitable for those who want to be sure and certain of the future. Some of the clients that I have worked with needs to have a grasp of the future so they can do the precise calculation on how much they have to fork out for a certain period. For these types of people, the financial security of having a fixed set of payment over a certain period greatly outweighs what other types of mortgages offers.
At any point in time, fixed rate home loans will have higher interest than floating rate home loans. If you are planning to stay in your house for a long period of time, a fixed rate housing loan is pretty sensible to you. Your kind of job plays an important factor in determining if a fixed rate is for you. If you work in a relatively safe job and are looking forward to a promotion every one to three years, it makes sense to go for a fixed ratehousing loan as well. With the increase in your paycheck, the burden of paying off a fixed rate housing loan gets smaller each year.
A fixed rate housing loan is also suitable for a person who is going to retire soon. Unless you have a lot of cash waiting for you, retirement requires careful planning. To ensure your finances do not deviate too far from your planning, it is better to fix your rates and know the exact amount of installment to work with every month. It is no joke missing out on your installments when you are in your retirement age. You risk having the bank foreclosing on your house and even if you declare bankrupt, it is pretty useless too. A housing loan does not get wiped out when you declare as a bankrupt.
Some people do not mind paying slightly more on their monthly installment as long as they have the certainty of having a set payment. If you feel you belong to these group of people, consider a fixed ratehousing loan.

But do take note that the mortgage rates are also falling. So this is a very good incentive for you to seriously consider buying a new house or refinancing your existing mortgage.
Some Statistics to Consider
For 30-year fixed rate loans, the national average has fallen to below 5 percent. This is the first time in more than 30 years that the five percent benchmark for fixed rate mortgage has been breached. So it is expected that more and more homeowners will benefit from this. If you are planning to buy a house, then today is the best time to make your move. The drop in fixed rate mortgage could mean big savings in the long run.
Obviously, there is still speculation that the homes market has not reached its bottom. So there are expectations that prices and interest rates will still go down. As a result, there are so many homeowners who are waiting for the rates to further go down.
However, the general values of homes remained stable. For example, the median home price across the nation is just under $120,000. So, the fact that home prices seem stabilizing coupled with the drop in fixed rate mortgage could be good signs that this is the right time to snatch a good deal.
Lower Rates Mean Lower Monthly Payments
With fixed rate of six percent, you may be able to afford a home worth $100,000. At this rate, you can keep monthly mortgage payments at around $600. In case the fixed interest rates will further drop by a percentage point, then you could afford a home worth $115,000 without spending more money per month on mortgage payments.
The added 15 thousand dollars may not look big enough for some people. However, this amount could mean an extra bedroom for your home or some amenity that you might want to install or construct on your property.
The drop in mortgage rate is attracting not just first time buyers but homeowners want to refinance their existing mortgage. Refinancing a mortgage with a smaller interest rate could mean a lot for your budget.
So if you think that you are getting a good deal from the 6 percent fixed interest rate, the current drop to 5 percent and lower is definitely a much better deal. This means that you will be able to save lots of money because your monthly mortgage payments would be significantly lower. This could also mean that you can pay off your home sooner.
You can gain a lot if fixed rate mortgage drops. Lower mortgage means more activity in the housing market. So this could be the best time to find favorable deals from mortgage lenders.

Variable Or Fixed Rate Mortgage, Do You Know Which One to Choose?

Whether you need a new mortgage or your mortgage is coming for a renewal, you will need to decide which kind of mortgage to choose.
Fixed rate mortgage gives you the comfort of knowing that your payments and interest rate will stay the same throughout the term of the mortgage. It will allow you to budget and give you peace of mind.
On the other hand the variable rate mortgage will offer you a lower interest rate, the savings are very obvious and you can see these savings beginning the very first payment. Not only that, if the rates go down you will benefit even more while the fixed rate mortgage will not allow you to take advantages of the dropping interest rates. These obvious benefits come with a risk-the risk that the fixed rate mortgage does not share. There is always a risk that the rates may go up and either you will pay a lot less towards principal or the stage may even reach that your payments may not even cover the interest payments. While in many variable rate mortgages the payments remain the same while the rate fluctuates, in rare cases, where, the monthly payments may be adjusted to reflect steep increase in interest rate (you must check the mortgage documents, carefully to confirm that, in a credit line set up where the monthly payments are geared to interest rates, the monthly payments definitely change with interest rates), it could really mess up your finances.
It must be pointed out that the variable rate mortgages do offer the option to convert your mortgage to a fixed rate mortgage in the event rates start creeping up and you begin losing sleep. But many find making this decision even more difficult when under financial pressure.
Confused, well you are not alone. If it is of any comfort most of the borrowers are! Nevertheless, once you have the relevant information, you will be able to make a calculated move based on your tolerance of risk and personal financial situation.
There is enough evidence that variable rate mortgages do save money to the consumer. Based on a statistical study done, at York University, of the mortgage rates between year 1950 and 2007, choosing a variable rate mortgage would have saved over $20,000 dollars over a period of 15 years. This figure is based on when a fixed rate $100,000 mortgage was compared with a variable rate mortgage. Obviously, the savings would have been much greater for a bigger mortgage. During this time, even though rates spiked several times, Canadians with variable rate mortgage would have been better of 89% of the time over a fixed rate mortgage.
So, which kind of mortgage are you going to choose? If you want to choose a variable rate mortgage, you must be comfortable with the interest rate fluctuations and be able to tolerate up to 20% variation in your mortgage payments and have other financial resources to draw upon when needed...
If you are of worrying type and have no tolerance for risk, the variable rate mortgage may not be for you.

5 Year Fixed Rate Mortgages - Who is Offering This Mortgage?

By Julian Lenox
What are Five Year Fixed Rate Mortgages?
Its name is kind of self-explanatory. A five year fixed rate mortgage is a mortgage in which your interest rate is fixed. These mortgages in general are very popular since they minimize the risk of a variable rate, which causes uncertainty, especially at these times where the financial crisis has hit all of us.
Which are the Most Popular Banks to have offered 5 Year fixed Rate Mortgages throughout the Years?
Well there are many banks and financial entities that have been offering this kind of mortgages for quite some time now. However, only some of them truly contributed to this type of mortgage. Those are the very same ones that offer the best options when it comes to mortgages. HSBC, Nationwide, and Yorkshire BS are some examples.
HSBC Five Year Fixed Rate Mortgages
HSBC has been offering 5 year fixed rate mortgages for many years now. Its rate is of 4.73% and they can loan up to 60% of the total value of the property. The only extra fee they charge is a booking fee. One of the best things about HSBC'S mortgage line is that you can apply for it online.
Nationwide Five Year Fixed Rate Mortgages
Over the years, Nationwide has offered pretty good deals on five year fixed rate mortgages. However, that is no longer the case. Nationwide has announced that during this year, there will be increases in their mortgages. Especially on these mortgages, which will rise by 0.86% to 5.84%.
This applies for customers looking to borrow less than 60% of the total value of the property. For those who are borrowing more, even though there will be an increase in the rate, it will not be as dramatic as that applied to the other group of borrowers. So if you belong to the first group, be aware that a significant increase on your rate is about to take place.
Yorkshire BS Five Years Fixed Rate Mortgages
Yorkshire Building Society is known for offering mortgages that are affordable even for first time buyers. But those who are remortgaging or moving homes can also find an option at this bank. For five years fixed rate mortgages, their rates start at 3.59 per cent.
Furthermore, Yorkshire BS has announced that they are launching a line of fee-free mortgages, and they will be able to do it by halving the products' fees and offering £250 cash back. This is by far the financial entity that has contributed the most to the mortgages market. Plus, its mortgages products are varied and suit most borrowers.
